1. Definitions

In these Terms and Conditions:

"Harborview," "we," "our," or "us" refers to the senior living residence operating at 45/23 Srinakarin Road, Khwaeng Nong Bon, Khet Prawet, Bangkok 10250, Thailand
"You," "your," or "resident" refers to individuals using our services or participating in our programs
"Services" includes information sessions, trial residence periods, and community membership
"Community" refers to the Harborview residential facility and its common areas
"Agreement" refers to these Terms and Conditions and any service-specific agreements

2. Acceptance of Terms

By contacting us, visiting our facilities, participating in an information session, trial period, or membership, you agree to be bound by these Terms and Conditions. If you do not agree with these terms, please do not use our services.

You must be at least 18 years of age to enter into these Terms and Conditions. Our services are designed for adults and are not directed to individuals under 18.

3. Services Description

3.1 Information Sessions

Information sessions are complimentary conversations about Harborview and our services. These sessions:

Can occur at our facility, a location of your choosing, or via video call
Provide information about our community and services
Create no obligation for either party
Are conducted during agreed-upon times

3.2 Trial Residence Period

The trial residence period is a one-month stay that includes:

Temporary apartment accommodation
Three daily meals in our dining room
Access to all common areas and activities
Housekeeping services
The trial period fee is ฿32,000 for the full month
Payment is due in full at the start of the trial period
The trial period is non-refundable once started

3.3 Community Membership

Community membership provides long-term residence including:

Private apartment (unfurnished, allowing personal furnishing)
Three daily meals
Housekeeping and maintenance services
Access to all community facilities and activities
Staff assistance as needed
Monthly membership fee of ฿49,500
Payment due on the first day of each month
Month-to-month arrangement with no long-term commitment required

4. What Is Not Included

Harborview is a residential community, not a medical facility. Our services do not include:

Medical care, nursing services, or health treatments
Personal care assistance (bathing, dressing, toileting)
Medication management or administration
Transportation to medical appointments or other locations
Personal items, toiletries, or medications
Telephone or internet service in apartments
Cable television service

Residents are responsible for arranging and paying for any medical care, personal care services, or transportation they require.

5. Payment Terms

5.1 Accepted Payment Methods

We accept payment by bank transfer, check, or cash. All fees are in Thai Baht (฿).

5.2 Payment Schedule

Trial period fees are due in full before the trial period begins
Monthly membership fees are due on the first day of each month
Late payments may result in late fees of 2% per month
Consistent late payment may result in termination of membership

5.3 Fee Changes

We reserve the right to adjust fees with 60 days' written notice to residents. Current residents may choose to accept the new fees or terminate membership with 30 days' notice.

6. Resident Responsibilities

As a resident or trial participant, you agree to:

Treat other residents, staff, and property with respect
Follow community guidelines regarding noise, visitors, and common area usage
Maintain your apartment in reasonable condition
Report maintenance issues promptly
Manage your own health care and medications
Provide emergency contact information and keep it current
Respect others' privacy and personal space
Not engage in illegal activities on the premises

7. Termination

7.1 Termination by Resident

Residents may terminate membership at any time with 30 days' written notice. You are responsible for payment through the end of the notice period.

7.2 Termination by Harborview

We may terminate membership immediately if:

You engage in behavior that threatens the safety or wellbeing of others
You consistently fail to pay fees when due
Your health needs exceed our capability as a residential community
You violate these Terms and Conditions in a material way

In other circumstances, we will provide 30 days' written notice before terminating membership.

8. Liability and Disclaimers

8.1 Services Provided "As Is"

Our services are provided on an "as is" basis. While we strive to maintain quality standards, we make no representations about the suitability of our services for any particular individual's needs.

8.2 Not Medical Advice

Nothing we provide constitutes medical advice or professional health guidance. Residents are responsible for their own health management and should consult qualified healthcare providers for medical matters.

8.3 Limitation of Liability

To the maximum extent permitted by Thai law, Harborview's liability is limited to the amount of fees paid by you in the three months preceding any claim. We are not liable for indirect, consequential, or incidental damages.

8.4 Personal Property

We are not responsible for loss, theft, or damage to residents' personal property. We recommend residents maintain appropriate insurance for their belongings.

9. Indemnification

You agree to indemnify and hold harmless Harborview, its staff, and affiliates from any claims, damages, or expenses arising from your use of our services, violation of these terms, or violation of any rights of another person.

10. Privacy and Data Protection

Your use of our services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using our services, you consent to our data practices as described in the Privacy Policy.

11. Dispute Resolution

11.1 Governing Law

These Terms and Conditions are governed by the laws of Thailand. Any disputes will be resolved in accordance with Thai law.

11.2 Jurisdiction

The courts of Bangkok, Thailand have exclusive jurisdiction over any disputes arising from these Terms and Conditions.

11.3 Informal Resolution

Before pursuing legal action, we encourage you to contact us directly to resolve any disputes informally.

12. General Provisions

12.1 Entire Agreement

These Terms and Conditions, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and Harborview.

12.2 Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

12.3 Waiver

Our failure to enforce any right or provision of these terms does not constitute a waiver of that right or provision.

12.4 Assignment

You may not assign or transfer these terms without our written consent. We may assign our rights and obligations under these terms.

12.5 Notices

All notices under these terms must be in writing and delivered to the addresses specified in the Contact section below.

13. Changes to These Terms

We may update these Terms and Conditions from time to time. We will notify current residents of material changes at least 30 days before they take effect. Updated terms will be posted on our website with a new "Last Updated" date.

Continued use of our services after changes become effective constitutes acceptance of the updated terms.
